TheCommissionCommunicationof30July1996ontheReviewoftheCommunityStrategyforWasteManagementestablishedguidelinesforfutureCom-munitywastepolicy.ThatCommunicationstressestheneedtoreducethequantitiesofhazardoussubstancesinwasteandpointsoutthepotentialbenefitsofCom-munity-wideruleslimitingthepresenceofsuchsubstancesinproductsandinproductionprocesses.Itfurtherstatesthat,wherethegenerationofwastecannotbeavoided,thatwasteshouldbereusedorrecoveredforitsmaterialorenergy.

TheCouncilResolutionof25January1988onaCom-munityactionprogrammetocombatenvironmentalpollutionbycadmium(5)stressedthelimitationoftheusesofcadmiumtocaseswheresuitablealternativesdonotexistandthecollectionandrecyclingofbatteriescontainingcadmiumasmajorelementsofthestrategyforcadmiumcontrolintheinterestsoftheprotectionofhumanhealthandtheenvironment.

Itisdesirabletoharmonisenationalmeasuresconcerningbatteriesandaccumulatorsandwastebatteriesandaccumulators.TheprimaryobjectiveofthisDirectiveistominimisethenegativeimpactofbatteriesandaccumulatorsandwastebatteriesandaccumulatorsontheenvironment,thuscontributingtotheprotection,preservationandimprovementofthequalityoftheenvironment.ThelegalbaseisthereforeArticle175(1)oftheTreaty.However,itisalsoappropriatetotakemeasuresatCommunitylevelonthebasisofArticle95(1)oftheTreatytoharmoniserequirementsconcerningtheheavymetalcontentandlabellingofbatteriesandaccumulatorsandsotoensurethesmoothfunctioningoftheinternalmarketandavoiddistortionofcompetitionwithintheCommunity.

PARTA:TREATMENT

1.Treatmentshall,asaminimum,includeremovalofallfluidsandacids.

2.Treatmentandanystorage,includingtemporarystorage,attreatmentfacilitiesshalltakeplaceinsiteswithimperme-ablesurfacesandsuitableweatherproofcoveringorinsuitablecontainers.PARTB:RECYCLING

3.Recyclingprocessesshallachievethefollowingminimumrecyclingefficiencies:

(a)recyclingof65%byaverageweightoflead-acidbatteriesandaccumulators,includingrecyclingoftheleadcontenttothehighestdegreethatistechnicallyfeasiblewhileavoidingexcessivecosts;(b)recyclingof75%byaverageweightofnickel-cadmiumbatteriesandaccumulators,includingrecyclingofthe

cadmiumcontenttothehighestdegreethatistechnicallyfeasiblewhileavoidingexcessivecosts;and(c)recyclingof50%byaverageweightofotherwastebatteriesandaccumulators.
