BOARD OF APPEALS
SECTION A101GENERAL
A101.1Scope.AboardofappealsshallbeestablishedwithinthejurisdictionforthepurposeofhearingapplicationsformodificationoftherequirementsoftheInternationalFireCodepursuanttotheprovisionsofSection108.Theboardshallbeestablishedandoperatedinaccordancewiththissection,andshallbeauthorizedtohearevidencefromappellantsandthecodeofficialpertainingtotheapplicationandintentofthiscodeforthepurposeofissuingorderspursuanttotheseprovi-sions.
A101.2Membership.Themembershipoftheboardshallcon-sistoffivevotingmembershavingthequalificationsestab-lishedbythissection.Membersshallbenominatedbythecodeofficialorthechiefadministrativeofficerofthejurisdiction,subjecttoconfirmationbyamajorityvoteofthegoverningbody.Membersshallservewithoutremunerationorcompensa-tion,andshallberemovedfromofficepriortotheendoftheirappointed terms only for cause.
A101.2.1Designprofessional.Onemembershallbeapracticingdesignprofessionalregisteredinthepracticeofengineeringorarchitectureinthestateinwhichtheboardisestablished.
A101.2.2Fireprotectionengineeringprofessional.Onemembershallbeaqualifiedengineer,technologist,techni-cian,orsafetyprofessionaltrainedinfireprotectionengi-neering,firescience,orfiretechnology.Qualifiedrepresentativesinthiscategoryshallincludefireprotectioncontractorsandcertifiedtechniciansengagedinfireprotec-tion system design.
A101.2.3Industrialsafetyprofessional.Onemembershallbearegisteredindustrialorchemicalengineer,certi-fiedhygienist,certifiedsafetyprofessional,certifiedhaz-ardousmaterialsmanager,orcomparablyqualifiedspecialistexperiencedinchemicalprocesssafetyorindus-trial safety.
A101.2.4Generalcontractor.Onemembershallbeacon-tractorregularlyengagedintheconstruction,alteration,maintenance,repair,orremodelingofbuildingsorbuildingservices and systems regulated by the code.
A101.2.5Generalindustryorbusinessrepresentative.Onemembershallbearepresentativeofbusinessorindus-trynotrepresentedbyamemberfromoneoftheothercate-gories of board members described above.
A101.3Termsofoffice.Membersshallbeappointedfortermsoffouryears.Nomembershallbereappointedtoservemorethan two consecutive full terms.
A101.3.1Initialappointments.Ofthemembersfirstap-pointed,twoshallbeappointedforatermof1year,twoforaterm of 2 years, one for a term of 3 years.

A101.3.2Vacancies.Vacanciesshallbefilledforanunex-piredterminthemannerinwhichoriginalappointmentsarerequiredtobemade.Membersappointedtofillavacancyinanunexpiredtermshallbeeligibleforreappointmenttotwofull terms.
A101.3.3Removalfromoffice.Membersshallberemovedfromofficepriortotheendoftheirtermsonlyforcause.Continuedabsenceofanymemberfromregularmeetingsoftheboardshall,atthediscretionoftheapplicablegoverningbody,renderanysuchmemberliabletoimmediateremovalfrom office.
A101.4Quorum.Threemembersoftheboardshallconstituteaquorum.Invaryingtheapplicationofanyprovisionsofthiscodeorinmodifyinganorderofthefireofficial,affirmativevotesofthemajoritypresent,butnotlessthanthreeaffirmativevotes shall be required.
A101.5Secretaryofboard.Thecodeofficialshallactassec-retaryoftheboardandshallkeepadetailedrecordofallitspro-ceedings,whichshallsetforththereasonsforitsdecisions,thevoteofeachmember,theabsenceofamember,andanyfailureof a member to vote.
A101.6Legalcounsel.Thejurisdictionshallfurnishlegalcounseltotheboardtoprovidememberswithgenerallegalad-viceconcerningmattersbeforethemforconsideration.Mem-bersshallberepresentedbylegalcounselatthejurisdiction’sexpenseinallmattersarisingfromservicewithinthescopeoftheir duties.
A101.7Meetings.Theboardshallmeetatregularintervals,tobedeterminedbythechairman.Inanyevent,theboardshallmeet within 10 days after notice of appeal has been received.A101.8Conflictofinterest.Memberswithamaterialorfinan-cialinterestinamatterbeforetheboardshalldeclaresuchin-terestandrefrainfromparticipatingindiscussions,deliberations, and voting on such matters.
A101.9Decisions.Everydecisionshallbepromptlyfiledinwritingintheofficeofthecodeofficialandshallbeopentopublicinspection.Acertifiedcopyshallbesentbymailoroth-erwisetotheappellant,andacopyshallbekeptpubliclypostedin the office of the code official for 2 weeks after filing.
A101.10Procedures.Theboardshallbeoperatedinaccor-dancewiththeAdministrativeProceduresActofthestateinwhichitisestablishedorshallestablishrulesandregulationsforitsownprocedurenotinconsistentwiththeprovisionsofthis code and applicable state law.
